Terms of Use

You must be at least 18 years old and able to enter a binding contract to use Nuvid. You are responsible for the security of your credentials and for all activity under your account.

You agree not to use the Service to generate content that is illegal, infringing, deceptive, defamatory, sexually explicit involving minors, or that impersonates real individuals without consent. You will not scrape, reverse engineer, overload, bypass rate limits, test security without permission, or attempt to disrupt the Service.

You are responsible for ensuring that your campaigns, emails, ads, claims, targeting, connected accounts and published outputs comply with applicable laws and platform policies, including consumer protection, privacy, intellectual property, advertising, email marketing, influencer disclosure and ecommerce rules.

You retain ownership of the URLs, brand assets, scripts and inputs you submit ("Inputs"). You grant Nuvid a worldwide, non-exclusive license to process Inputs solely to operate and improve the Service.

Subject to your compliance with these Terms and payment of applicable fees, you own the videos and assets generated for you by the Service ("Outputs"), and may use them for commercial purposes. You are responsible for ensuring Outputs comply with applicable advertising standards and platform policies (Meta, TikTok, YouTube, etc.).

Nuvid does not guarantee that Outputs will be unique, error-free, non-infringing, approved by any ad platform, or suitable for a specific regulated use. You must review and approve all Outputs before publishing.

Paid plans and credit packs are billed in advance and are non-refundable except where required by law. Credits are consumed when a generation or remix job is submitted. Unused credits expire 12 months after purchase.

Customer subscriptions, credit packs and normal Nuvid purchases are processed through Stripe Checkout or Stripe Billing. Stripe Connect, if enabled, is used only for marketplace, creator, partner or payout flows and not for ordinary customer subscriptions unless expressly stated.

Eligible customers on the Growth plan or a higher Nuvid subscription plan may qualify for Nuvid's 20% Growth Guarantee. The guarantee does not apply to free accounts, one-off credit packs, top-ups, trials, or plans below Growth. If, after 90 consecutive days of active paid use, connected tracking shows that the customer's store revenue has not increased by at least 20% compared with the agreed baseline period, the customer may request a refund of eligible Nuvid subscription fees paid for that 90-day guarantee period.

The guarantee requires: an agreed baseline, active Shopify or WooCommerce store connection, connected ad or revenue tracking, reasonable campaign activity using Nuvid-generated creative, and no material tracking gaps, store shutdowns, major stockouts, payment failures, ad account bans, or other external events that prevent fair measurement. The guarantee does not cover advertising spend, third-party fees, taxes, usage top-ups, implementation services, or revenue affected by factors outside Nuvid's control.

Refund requests must be submitted to billing@nuvid.ai within 14 days after the 90-day period ends. Nuvid may request reasonable evidence to verify eligibility and measurement.

Outputs are produced by machine learning models and may contain inaccuracies, bias, outdated information, unsupported claims or formatting errors. Nuvid provides creative and workflow assistance, not legal, medical, tax, financial, accounting or professional advice.

If you connect Shopify, WooCommerce, Google, Meta, TikTok, YouTube, Stripe or other third-party services, you authorize Nuvid to access and process the connected data needed to provide the requested functionality. You represent that you have permission to connect those accounts and submit the related data.

Third-party services are governed by their own terms and privacy policies. Nuvid is not responsible for third-party outages, policy changes, account restrictions, ad disapprovals, API limits or platform enforcement actions.

If you upload contact lists or use Nuvid for outreach, you must have a lawful basis and all required permissions to contact recipients. You must not upload purchased, scraped or harvested personal email lists unless you can lawfully use them. You must honor unsubscribes, bounces, complaints and suppression lists.

Nuvid may provide unsubscribe tooling, suppression handling and campaign workflow assistance, but you remain responsible for your email content, targeting and compliance with GDPR, ePrivacy, CAN-SPAM, CASL and other applicable laws.

Where Nuvid processes personal data on behalf of a business customer, the Data Processing Addendum applies unless the parties have signed a separate data processing agreement.

Nuvid may offer marketplace, creator, partner, affiliate or agency features. Any payout eligibility, referral fee, creator share, partner commission or marketplace participation is subject to approval, fraud review, tax requirements, Stripe Connect onboarding where applicable, and any separate partner or marketplace terms.

Founding Company, Founding Partner, creator or partner status is recognition, access and platform participation. It does not imply equity, ownership, employment, legal co-founder status or authority to bind Nuvid unless expressly agreed in a signed written agreement.

We may suspend or terminate your account for breach of these Terms. You may cancel at any time from your billing dashboard.

To the maximum extent permitted by law, Nuvid's aggregate liability arising out of or related to the Service is limited to the amounts paid by you to Nuvid in the 12 months preceding the claim.

You agree to defend and indemnify Nuvid from claims arising from your Inputs, published Outputs, campaigns, connected accounts, customer lists, unlawful outreach, breach of these Terms, or violation of laws or third-party rights.

Unless your order form states otherwise, these Terms are governed by the laws applicable to the Nuvid contracting entity, without regard to conflict-of-law rules. Mandatory consumer or data-protection rights remain unaffected.

We may update these Terms from time to time. Material changes will be notified by email or in-product notice.
